This Disclaimer applies to your use of the planespottr iPhone app, the planespottr Apple Watch app and the watch face complication (together, the "App"), operated by x8 Data Company LLC ("we," "us," or "our"). By downloading, accessing or using the App, you agree to this Disclaimer. If you do not agree, do not use the App.

1. General Information

planespottr is an aircraft spotting game that shows aircraft flying near you and lets you record the ones you see. All information in the App is provided for informational and entertainment purposes only. Nothing in the App is professional, aviation, navigation, weather or safety advice.

2. No Aviation, Navigation or Safety Use

planespottr is not an aviation, air traffic control or navigation tool, and it is not affiliated with, endorsed by or approved by the FAA or any other aviation authority, or by any airline, airport or aircraft manufacturer. Airline names and logos belong to their owners and are used only to identify aircraft.

The App must never be used to:

  • Navigate, operate or direct any aircraft, drone or vehicle
  • Make aviation, air traffic or safety decisions
  • Locate, track or follow any aircraft or person for any purpose other than casual spotting

3. Your Safety While Spotting

Spotting happens in the real world, and you are responsible for your own safety and conduct.

  • Stay aware of your surroundings. Do not look at your phone or watch while walking near traffic, and never use the App while driving or operating a vehicle or machinery.
  • Stay out of restricted, secure and private areas. Never enter airport airside areas, runways or their surroundings, or trespass on private property, to spot an aircraft.
  • Follow the instructions of airport staff, security, police and property owners.
  • Laws about photographing aircraft, airports and military or government sites differ from place to place, and some activity near airports may draw the attention of security. Know and follow the laws where you are.
  • Never point lasers, lights or drones at aircraft.

We are not responsible for any injury, damage, fine, detention or other consequence arising from where or how you spot aircraft.

4. Data Accuracy and Limitations

The App relies on third-party data, including flight tracking, aircraft, route, photo and weather data. As a result:

  • Aircraft may be missing, shown in the wrong place, or shown late, especially in areas with poor receiver coverage
  • Aircraft positions between updates are estimated, so an aircraft on the map may not be exactly where it really is
  • Registrations, types, airlines, flight numbers, origins and destinations may be wrong or out of date
  • Military, private and other aircraft may be hidden, incomplete or anonymized
  • Aircraft photos may show a different aircraft of the same type or in an older paint scheme
  • Distances, points and spot results are calculated from this data and from your device's location, and may be wrong

We do not guarantee the accuracy, completeness or timeliness of any information in the App.

5. AR Mode

AR mode draws aircraft over your camera view using your device's location, compass and motion sensors. These sensors can be inaccurate, especially near metal, magnets, buildings or other electronics, so labels may not line up with the real aircraft. AR mode is for fun only. When you spot in AR mode, the App saves a snapshot of the camera view to that spot.

6. Location and Apple Watch

The App depends on your device's ability to determine its location. Location can be inaccurate or unavailable indoors, in dense cities and in other conditions the App cannot control, which affects which aircraft are shown and whether you can spot them. The Apple Watch app depends on your watch's location, connection and battery, and may show fewer aircraft or update less often than the iPhone app.

7. Weather Layers

Rain, cloud and turbulence layers come from third-party data, may be delayed, approximate or unavailable, and are shown for interest only. Do not use them for any travel, flight or safety decision.

8. Third-Party Content and Dependencies

Aircraft photos come from Planespotters.net and belong to their photographers. Maps, weather and flight data come from other providers. If these services have outages, delays or changes, the App may be partly or fully unavailable. We are not responsible for third-party content or services.

9. User Content

Spots, photos, comments, usernames and other content created by other users are their own. We do not review all user content before it appears and are not responsible for it. You can contact us about content that you believe breaks our Terms.

10. Points and Leaderboards

Points, ranks and leaderboards are part of a game, have no monetary value and may be adjusted, recalculated or reset at any time.

11. Paid Features

planespottr Pro unlocks additional features through an App Store subscription.

  • Paying for Pro does not guarantee uninterrupted service or the availability of any particular aircraft, data or feature
  • Features may change, be modified or be discontinued
  • Purchase validation, subscription status, renewals, cancellations and refunds depend on Apple, RevenueCat and other third-party systems

12. Device Impact

Using location, the camera, AR mode, maps and network data, and keeping the screen on, can increase battery use, mobile data use, processor load and device temperature. We are not responsible for battery drain, data charges, overheating, reduced performance, hardware failure or other effects on your devices.

13. Disclaimer of Warranties

YOUR USE OF THE APP IS ENTIRELY AT YOUR OWN RISK. THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE, OUR AFFILIATES OR OUR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, POINTS, USE, GOODWILL OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO, USE OF OR INABILITY TO ACCESS OR USE THE APP
  • ANY RELIANCE ON INFORMATION IN THE APP
  • ANY CONDUCT OR CONTENT OF ANY OTHER USER OR THIRD PARTY

15. Indemnification

You agree to indemnify, defend and hold harmless x8 Data Company LLC and its officers, directors, employees and agents from any claims, liabilities, damages, losses and expenses, including reasonable attorneys' fees, arising out of or connected with your use of the App, how and where you spot aircraft, or your violation of this Disclaimer.

16. Governing Law and Disputes

This Disclaimer is governed by the laws of the State of Texas and the United States, without regard to conflict-of-law rules. Any dispute arising out of this Disclaimer or your use of the App is subject to the binding arbitration and class action waiver provisions of our Terms of Service.

17. Other Policies

Your use of the App is also governed by our Terms of Service and Privacy Policy, which are incorporated by reference.

18. Severability

If any provision of this Disclaimer is held invalid or unenforceable, the remaining provisions remain in full force and effect.

19. Changes to This Disclaimer

We may update this Disclaimer at any time. Changes take effect when the updated Disclaimer is posted in the App, and we will change the "Last updated" date. Your continued use of the App after a change means you accept it.
